October 15 is not the statute. Square already began offloading.

Mixed-catalog retailers on Square were reportedly told to remove CBD, hemp, and hemp-derived items from their Square catalogs - online and in person - by October 15, 2026. After that date, those items are not permitted on the platform. Accounts stay open for non-CBD products. Square Loan repayment for mixed catalogs continues as before.

That is processor policy. It is not Public Law. It still hits the register before either federal hemp date under P.L. 119-103.

What Square actually said

Marijuana Moment published the seller email and a Square spokesperson confirmation. The email's federal citation is still a single line:

A new federal law takes effect on November 12, 2026 that redefines which hemp and hemp-derived products are legal.

Because of that change, Square said selling CBD and hemp-derived products - online or in person - will no longer be permitted on its platform. Required action: strip those SKUs from the catalog by October 15. After that date, they are barred. Non-CBD inventory can keep processing.

When asked whether Square would revise if Congress delayed or reversed the federal ban, the spokesperson said the company constantly evaluates policy and the compliance landscape and had nothing specific to share at that time.

Do not treat a secondary merchant-blog "Nov 5 hemp-primary closure" date as Square's confirmed letter unless you have your notice. Stick to the Oct 15 catalog pull Marijuana Moment documented.

What the statute actually is (after the signature)

H.R. 6500 is Public Law 119-103 (signed September 2, 2026). Enrolled section 2019 is a split clock, not a uniform Dec 11 rescue:

  • November 12, 2026 still hits for intermediate and final products with cannabinoids not capable of being naturally produced by Cannabis sativa L. - 7 U.S.C. section 1639o (1)(C)(ii)(I) and (1)(C)(iv)(I).

  • December 11, 2026 delays most of the rest of P.L. 119-37 section 781 (total-THC including THCA, 0.4 mg per innermost container, viable-seed exclusion, outside-the-plant conversions of plant-capable cannabinoids, industrial hemp as defined).

Square's October 15 deadline lands before November 12 and before December 11. A signed delay of most of section 781 does not rewrite a private catalog rule that already said CBD/hemp comes off the rail in mid-October.

Do not brief a buyer: "Congress moved hemp, so Square is fine until December." That sentence collapses three clocks into one headline.

Nov 12

Microregulator prediction

Payment rails move on underwriting and risk language, not on CRS In Focus updates. Expect Square's Oct 15 pull to hold unless Square publishes a new seller notice. Do not wait for the company's public CBD landing page to resurrect before you map SKUs. Do not assume Stripe, PayPal, or Shopify Payments quietly reopen the category because a CR delayed part of section 781 - those platforms were already restrictive or prohibitive for U.S. CBD under their own terms.

If your catalog is mostly hemp and you received a different Square letter with an account-closure date, treat that letter as your clock. Please share in the comments what date you were given.

Personal thoughts

The industry is still arguing about November versus December while the POS is already telling cashiers to delete the SKU in six weeks. That is the real operator pain this week: not another reprint of the signed split clock, but the rail that refuses to wait for either date.

Map every SKU on both federal clocks and against the processor that will still take the charge. Thynk Compliance Platform is built for that dual-map - which products survive Nov 12, which wait for Dec 11, and which cannot stay on a given payment rail after Oct 15. Consulting covers the migration letter to a hemp-capable processor when the catalog is not "a few CBD SKUs on a coffee shop Square."

Disclaimer. This article is operator analysis from Thynk Industries, not legal advice, not a lobbying communication, and not a prediction sold as a later statute. It is the thoughts and opinions of a company that tracks policy against enrolled Public Laws. A Marijuana Moment reprint, a language model, an unpublished FDA cannabinoid list, and a Discord "Square will reverse" rumor are not substitutes for your Square seller notice read against P.L. 119-103 section 2019 and 7 U.S.C. section 1639o. Counsel should read both before anyone deletes inventory, switches acquirers, or tells a retailer there is only one date.
